Cabinet of
Ministers of Ukraine offers to forbid the sale and pledge of the land plots
without cadastral number. This stands in the draft law, which was introduced
today to the relevant committee of the Verkhovna Rada (VR) of Ukraine.
According
to the document “land can be pledged or the rights on it can be transferred
when the cadastral number is assigned”.
Besides,
both designated purpose and cadastral number are offered to be submitted while
land mortgage.
On January
10, 2011 Vladymyr Lytvyn, Speaker of Parliament, called the VR to decide about
taking land inventory in Ukraine.
It is
instructive to recall that in December 2010 Deputy Chairman of the State
Committee of Ukraine for Land Recourses Sergey Belchik announced that the State Committee of
Ukraine for Land Recourses was ready to make every afford to create the state
system of land cadastre by the June 2012.
As
previously reported, On January 19, 2010 VR overridden Presidents’ veto on
legislation to prolong the moratorium on farmland buy and sell by the 1-st
January 2012. We remind that on December 22, 2009 VR enacted a law ‘On
amendments into paragraphs 14, 15 Title X “Transitional period provisions” of
the Land Code of Ukraine (concerns the term for land sale).
The Law
provides the ban term prolong for the rights on land share in economic society’s’
charted funds by the 1-st January 2012. The Law is expected to establishing the
government and communal farmland buy and sell, as well as changing of
designated purpose use, particularly exchanging of one land plot on another
implements from January 1, 2012.
However,
State Land Cadastre and Land Market Act have to come into force, determine the
features handling lands of government and communal property and commercial
agriculture lands.
It is
important that governmental enterprise “State Land Cadastre Centre” was founded
on December 2, 1997. The SLC Centre’s primary intent is functioning of the
State Land Cadastre automation system and land registration system of Ukraine.
Make a
point, according the Accounts Chamber of
Ukraine, within sexennial implementation of project “Issues of state acts on
property right to land in rural zone and cadastre system development”, financed
by the International Bank’s for Reconstruction and Development (IBRD)
corresponding credit, State Committee of Ukraine for Land Recourses and
governmental enterprise “State Land Cadastre Centre” have used only 23.7
million dollars (or 12.1%) from the total credit, and there are still risks of
non-use the loan till the project completion - June 30,2012, risks are provided
by IBRD to complete a project after its reorganization.
According
to the Public affairs office, social aims of project, in particular free
certificate’s on right to land ownership substitution for state acts, have
failed too and source of finance was lost. Over projects’ duration 422 thousand
state acts on right to land ownership were given instead of certificates, which
is only 11% from certain amount of reciprocation.
The risks
of non-fulfillment the standalone contracts of creating basic and index
cadastral maps are reserved and planned, so additionally loads on state budget
of Ukraine
connected with necessity to face the enforcement of treaty results in
