Since the 4-th of October
2010 came into
force the new Procedure for the monitoring of license provisions’ adhesion of
business activities for boundary survey and land charge works, signed into law by
order of the State Committee of Ukraine for Land Resources.
A new Procedure
for the monitoring of license provisions’ adhesion establishes the State
Agency able to implement such a control. Into the Procedure for the monitoring
of license provisions’ adhesion of business activities for boundary
survey and land charge works, signed into law since the 18-th of March 2003,
there were two subjects – State Committee of Ukrainian for Land Resources and
State Committee of Ukraine for Regulatory Policy and Entrepreneurship, but the new
procedure makes responsible for the monitoring only the State Committee of
Ukraine for Land Resources. These changes can be not of a big importance for
business activity entities, but for the government and distribution of
functions for the state structure.
The time
schedule for a kind of works and period for noticing by State Committee of
Ukraine for Land Resources the licensee about revisal – are those changes that are
much more important for licensee on business activities for boundary survey and
land charge works. Hold up as an example of comparison some figures. For
instance, according to the order on March 18, 2003 scheduled checking-over was
carried out after the audit plan but no more than once a year; a new order
claims that revisal can’t be held more than once a five years. As well about scheduled
check-outs there were some changes: from today business activity entities will
be informed in writing about scheduled revision in 10 work days (5 work days
previously); however the scheduled revisal period has been increased from 5
working days (10 working days in case of special conditions) up to 15 working
days, but without possibility to increase this duration. A new Procedure points
out a scheduled revisal period for small business that can’t exceed 5 working
days.
A new Procedure
makes changes in unscheduled check-outs’ mechanism. It is said that unscheduled
revisal can be no more than 10 working days and can’t exceed 2 working days for
small business, prolongation of term in both situations is not allowed.
